Welcome to CreatoMark. We provide white-label website, design, development, digital marketing and AI services for B2B agencies, so they can grow faster, save resources and deliver great results to their clients, all under their own brand.
By accessing or using our services, you agree to these Terms of Service and our Privacy Policy. Please read them carefully.
1. Our intellectual property
The CreatoMark name, logo, website, brand materials and our own internal tools, code libraries and know-how are the property of CreatoMark or its licensors. You may not use, copy or distribute them without our written consent.
2. Ownership of your work
Everything we create for you and your clients, including code, designs, content, accounts and files, belongs to you and your client from day one. Where a delivered project includes our own reusable tools or code, you receive a permanent licence to use them as part of that project.
If an invoice remains unpaid, we may pause work and our access until it is settled.
3. Third-party fonts, plugins and tools
We may use third-party fonts, themes, plugins or tools in our work. Clients are responsible for buying and keeping the right licences, and CreatoMark is not liable for problems caused by third-party products.
4. Your responsibilities
By using our services, you confirm that:
- You have the authority to enter into this agreement.
- You will comply with all applicable laws and regulations.
- The information you give us is accurate and complete.
5. Prohibited use
You may not use our services for:
- Illegal or harmful purposes, such as hacking, phishing or spam.
- Infringing the intellectual property rights of others.
- Violating the privacy or security of third parties.
6. Confidentiality
We keep information about you, your clients and your projects confidential. We are happy to sign your NDA before we see any project, and our delivery team works under the same confidentiality terms.
7. Feedback and testimonials
We value your feedback and may use it to improve our services. We will only publish your name, photo, company or words as a testimonial with your permission.
8. Management and quality control
CreatoMark manages, oversees and quality-checks all work we deliver. Where we involve specialist providers, they work under our supervision and the same confidentiality terms.
9. Plans, payments and cancellation
Monthly plans run month-to-month. You can cancel at any time before your next billing date, and you keep everything delivered up to that point. Project work is billed as agreed in the project proposal.
10. Satisfaction, revisions and refunds
If you are not happy with our work and your concern is reasonable, we will revise the work until you are satisfied or issue a refund, depending on the project type and agreement.
11. Privacy
We are committed to protecting your data. Please read our Privacy Policy to understand how we collect, use and protect your information. By using our services, you consent to that processing.
12. Service interruptions
CreatoMark is not responsible for disruptions caused by your internet provider, hosting, or other technical failures outside our control.
13. Disclaimer
Our services are provided “as is,” without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.
14. Limitation of liability
CreatoMark is not liable for any indirect, incidental or consequential damages arising from your use of our services. You agree to indemnify and hold us harmless against claims resulting from misuse of our services.
15. Electronic communication and signatures
You agree to deal with CreatoMark electronically, including contracts, approvals and communications.
16. Referral Program
If you introduce new clients to us, you may be eligible for rewards under our Referral Program.
17. Governing law
These Terms are governed by the laws of the State of New Mexico, United States.
18. Dispute resolution
Any disputes will be resolved through binding arbitration under applicable arbitration rules, rather than in court.
19. Changes to these Terms
We may update these Terms of Service at any time. We will announce material changes by email or with a notice on our website. The “Last updated” date shows the latest version.
20. Entire agreement
These Terms, together with our Privacy Policy and any signed proposal or agreement for your project, form the entire agreement between you and CreatoMark and replace any earlier agreements.
